MergeTender is a payment aggregation platform designed for restaurant businesses. The Service connects to third-party payment platforms such as Clover and Square, aggregates transaction data, and provides business intelligence including customer segmentation, revenue analytics, and loyalty program management.

3. Account Registration

• You must provide accurate and complete information when creating an account.
• You are responsible for maintaining the confidentiality of your account credentials.
• You must be at least 18 years old to use the Service.
• You are responsible for all activity that occurs under your account.
• You must notify us immediately of any unauthorized use of your account.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any regulations
• Attempt to gain unauthorized access to any part of the Service
• Interfere with or disrupt the integrity or performance of the Service

MergeTender integrates with third-party payment platforms including Clover and Square. By connecting these platforms to MergeTender:

• You authorize MergeTender to access your transaction and merchant data through the respective platform's API.
• You confirm that you have the authority to grant this access for your business account.
• You acknowledge that MergeTender is not affiliated with or endorsed by Clover, Square, or any other integrated platform.
• You can revoke platform access at any time through the connected platform's settings or through MergeTender's connect page.

6. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms of Service by reference. By using the Service, you consent to the collection and use of your information as described in the Privacy Policy.

7. Subscription and Billing

• MergeTender offers subscription plans as described on our pricing page.
• Free trial periods, where offered, provide full access to the Service for the specified duration without charge.
• Paid subscriptions are billed in advance on a monthly or annual basis.
• You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.
• We reserve the right to change pricing with 30 days advance notice to existing subscribers.
• Refunds are provided at our discretion on a case-by-case basis.

8. Intellectual Property

The Service, including its design, features, code, and content, is owned by MergeTender and protected by intellectual property laws. Your business data remains your property — we claim no ownership over your transaction records or customer information.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. MergeTender does not warrant that the Service will be uninterrupted, error-free, or completely secure. We do not guarantee the accuracy or completeness of any data aggregated from third-party platforms.

10. Limitation of Liability

To the maximum extent permitted by law, MergeTender shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability to you for any claims arising from the Service shall not exceed the amount you paid us in the three months preceding the claim.

11. Termination

We reserve the right to suspend or terminate your account at our discretion if you violate these Terms of Service or engage in conduct that we determine to be harmful to other users or the Service. You may terminate your account at any time by contacting us. Upon termination, your right to use the Service ceases immediately.
